What is a Personal Injury?

As the name suggests a “Personal Injury” is harm or damage endured by an individual. The harm can either be physical, such as a broken leg or head injury or it can be a financial harm such as in a business conflict. The legal patronage of personal injury also consists of libel, slander, and defamation.

How Are Personal Injury Cases Resolved?

Majority of us have an indication that all personal injury applicants should have their “day in court.” Though this is accurate some of the time, generally most cases will never end up in a courtroom. Keep in mind, the goal of your personal injury attorney is to collect the utmost client recovery in your case; this does not always involve the courtroom or a trial. Although some personal injury cases become formalized in civil court proceedings, it is a lot more common that your dispute will be solved through informal settlement before a lawsuit is filed.

Formal “Lawsuit”.

A formal personal injury case begins when the “plaintiff” (the injured party) files a civil “complaint” against another person, business, corporation, or government agency. The plaintiff is alleging that they acted recklessly or irresponsibly in correlation with an accident or injury, which caused harm. This action is primarily recognized as “filing a lawsuit”.

Informal Settlement.

In truth, most disputes over liability for an accident or injury are solved through informal early settlement. Typically among those personally situated in the dispute, their insurers, and attorneys representing both of the sides. A settlement will usually take the form of negotiation, then followed by a written agreement in which both sides forgo any further action (like filing a lawsuit), choosing instead to settle the matter through payment of an agreeable amount of money.
